Overview

This website is operated by Cheuk's Wellness & TCM ("we", "us", "our"), an ATCM-registered Traditional Chinese Medicine practice based at 96a High Street, Staple Hill, Bristol BS16 5HL. Our online store, including our Vital Duo botanical wellness range, is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.

These terms and conditions, together with any policies referenced here (the "Terms of Service" or "Terms"), describe your rights and responsibilities when you use our website and purchase our products (the "Services"). By visiting our site or purchasing from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Please read these Terms carefully — they include important information about your legal rights.

Section 1 — Wellness products, not medical treatment

Our Vital Duo range and other retail products are botanical wellness products designed to support general wellbeing. They are foods, not medicines. They are not intended to diagnose, treat, cure, or prevent any disease, and they are not a substitute for medical diagnosis or treatment. Always consult your GP for medical concerns. If you are pregnant, nursing, or taking medication, please consult your healthcare provider before use.

Clinical treatment — acupuncture, herbal prescription, and cupping — takes place in the clinic under separate consultation and is not governed by an online purchase.

Section 2 — Using the Services

By agreeing to these Terms, you confirm you are at least 18 years of age, or have the consent of a parent or guardian. You agree to provide accurate, current, and complete information when using the Services, and you are responsible for keeping your account credentials secure. You may not use our products or Services for any unlawful purpose, transmit malicious code, or attempt to interfere with the security or operation of the Services. We reserve the right to refuse service and to suspend or terminate accounts that breach these Terms.

Section 3 — Products

We make every effort to represent our products accurately, but colours and appearance may vary depending on your screen. As our products are crafted from natural botanicals, minor variation between batches is normal. Product descriptions and availability are subject to change without notice, and we may discontinue or limit quantities of any product at our discretion.

Section 4 — Orders, prices and billing

When you place an order, you are making an offer to purchase; your order is accepted when we confirm it. We must receive and process your payment before an order is accepted. We may decline or cancel an order at our discretion — for example, where stock, pricing errors, or suspected fraud make fulfilment impossible — and will notify you using the contact details you provided.

Prices are in pounds sterling and are subject to change without notice. Unless stated otherwise, prices do not include shipping. You agree to provide current and accurate purchase and payment information, and that your purchases are for personal or household use, not commercial resale.

Section 5 — Shipping and delivery

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers or events outside our control. Once products are handed to the carrier, risk of loss passes to you. See our Shipping Policy for full details.

Section 6 — Returns and refunds

Purchases may be returned or exchanged in accordance with our Refund Policy. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

Section 7 — Intellectual property

All content on the Services — including the Cheuk's Wellness & TCM and Vital Duo names, logos, text, images, product designs, and formulations — is owned by us or our licensors and protected by intellectual property law. You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, or create derivative works from any material on the Services without our prior written consent.

Section 8 — Reviews and feedback

If you submit reviews, suggestions, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, and display that Feedback in any medium. You confirm your Feedback is your own, is accurate, and does not violate any third-party rights or contain unlawful material. We may monitor, edit, or remove Feedback at our discretion, and we are under no obligation to keep Feedback confidential or pay compensation for it.

Section 9 — Third-party links and tools

The Services may include links to third-party websites or optional third-party tools. We provide these "as is", without warranties, and are not responsible for third-party content, products, or services. Please review third-party policies before transacting with them.

Section 10 — Relationship with Shopify

Our store is powered by Shopify, but all sales are made directly with Cheuk's Wellness & TCM. Shopify is not responsible for any aspect of sales between you and us, and you release Shopify and its affiliates from claims arising from your purchases with us.

Section 11 — Errors and omissions

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, or availability. We reserve the right to correct errors and to change or update information, or cancel affected orders, at any time without prior notice.

Section 12 — Disclaimer of warranties

Information on the Services is provided for general information only. Except as expressly stated by us, the Services and all products are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that your use of the Services will be uninterrupted, secure, or error-free. Nothing in this section limits your statutory rights as a consumer.

Section 13 — Limitation of liability

To the fullest extent permitted by law, Cheuk's Wellness & TCM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or products purchased through them. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

Section 14 — Indemnification

You agree to indemnify and hold harmless Cheuk's Wellness & TCM and its personnel from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party rights.

Section 15 — General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies posted on this site, constitute the entire agreement between you and us regarding the Services. You may not assign your rights under these Terms without our written consent.

Section 16 — Governing law

These Terms of Service and any separate agreements whereby we provide you Services are governed by and construed in accordance with the laws of England and Wales, and you agree to the non-exclusive jurisdiction of the courts of England and Wales.

Section 17 — Changes to these Terms

We may update, change, or replace any part of these Terms by posting updates to this page. Your continued use of the Services following any changes constitutes acceptance of those changes.

Cancellation Policy

Cheuk's Wellness & TCM — including our Vital Duo botanical range

Some items in our store may be offered as a subscription or pre-order. This policy explains how to change or cancel these purchases.

Subscriptions

When you purchase a subscription, you'll receive repeat deliveries based on the duration and frequency you select. Your payment details are stored securely and you'll be charged for each delivery, unless you choose to pay in advance.

Some subscriptions may auto-renew at the end of their duration. If you don't want a subscription to renew, you can cancel it — at any time, with no notice period and no penalty. Your order confirmation emails contain links to your order, and you can manage or cancel your subscription from there. If you have any difficulty, email info@cheukstcm.org and we'll sort it for you.

Pre-orders

When you place a pre-order, you're buying a product not yet in stock. We may take no payment or a partial deposit at checkout, then charge the full or remaining amount when the order is fulfilled.

You can cancel a partially paid pre-order at any time before it has been fulfilled. Once fulfilled, the order can't be cancelled, but you can request a refund in line with our Refund Policy.

Clinic appointments

Clinic appointments are managed separately through our booking system. If you need to cancel or reschedule a treatment, please do so through your booking confirmation or contact the clinic — we kindly ask for at least 24 hours' notice so the time can be offered to another patient.
